These terms govern your use of the GitoCare website at gitocare.com. Use of the GitoCare platform by a clinic is governed by the separate written agreement (including a Business Associate Agreement) between GitoCare and that clinic; where that agreement conflicts with these terms, the agreement controls for platform use.
Not medical, legal, or financial advice. The website provides general information about our product. It is not medical, legal, billing, or financial advice, and using it does not create a professional relationship.
1. Acceptance
By accessing this website you agree to these terms. If you do not agree, please do not use the site.
2. Use of the website
You may use the site for its intended purpose — to learn about GitoCare and to contact us. You agree not to:
- Use the site unlawfully or to infringe others’ rights;
- Attempt to gain unauthorized access to our systems, disrupt the service, or probe for vulnerabilities except through a good-faith report to security@gitocare.com;
- Scrape, copy, or reuse site content except as reasonably necessary to evaluate our product.
3. Accounts and platform access
Access to the GitoCare platform is provided to clinics and their authorized users under a separate agreement. Those users are responsible for keeping their credentials secure and for activity under their accounts. We may suspend access to protect the platform or comply with the law.
4. Intellectual property
The GitoCare name, logo, site content, and software are owned by GitoCare Inc. or its licensors and are protected by law. We grant you no license except to view the site for evaluation. Clinic data entered in the platform belongs to the clinic; our rights to it are limited by the clinic agreement and the BAA.
5. Third-party links and services
The site may link to third-party sites or reference third-party services. We are not responsible for their content or practices.
6. Disclaimers
The website is provided “as is” without warranties of any kind, to the fullest extent permitted by law. We describe our security posture honestly on our Security page; we do not claim to be “HIPAA certified” or “SOC 2 certified” (SOC 2 is on our roadmap). Nothing here guarantees uninterrupted or error-free operation of the website.
7. Limitation of liability
To the fullest extent permitted by law, GitoCare will not be liable for indirect, incidental, special, or consequential damages arising from your use of the website. This section does not limit any liability that cannot be limited under applicable law, and it does not affect the terms of a clinic’s separate platform agreement.
8. Changes
We may update these terms; we will change the effective date above. Continued use of the site after a change means you accept the updated terms.
9. Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Platform use is governed by the governing-law terms of the applicable clinic agreement.
